Terms of Service

1. Acceptance of Terms

By creating an account, browsing, or booking a class through PilatesNow (the "Service"), you agree to these Terms of Service ("Terms"), which incorporate by reference our Privacy Policy below. If you do not agree, do not use the Service. PilatesNow is operated by PilatesNow LLC ("PilatesNow," "we," "us").

2. Definitions

  • "Studio" means an independent fitness business listing classes on the Service.
  • "Deal Booking" means a class reservation made at a discounted, time-sensitive price set by a Studio's pricing rules.
  • "Full-Price Booking" means a class reservation made at a Studio's standard listed price.
  • "User," "you" means any person who creates an account, browses, or books a class through the Service.
  • "Content" means any text, images, schedules, or other material made available through the Service.

3. Description of Service

PilatesNow is a booking platform that connects users with independent fitness studios ("Studios"). PilatesNow is not a fitness studio, does not employ instructors, and does not control, supervise, or guarantee any class, instructor, or studio facility. Studios are independent businesses solely responsible for the classes, instruction, and premises you access through the Service. PilatesNow facilitates discovery, booking, and payment; it is not a party to the underlying fitness service being purchased.

4. Eligibility

You must be at least 18 years old to create an account and book a class. By creating an account, you represent that you meet this requirement.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

6. Booking and Payment

  • All payments are processed through Stripe, our third-party payment processor. PilatesNow does not store your full payment card information.
  • Deal bookings, shown at a discounted, time-sensitive price, are charged in full at the time of booking.
  • Full-price bookings made through the Service are charged at exactly the studio's listed price — no added fee. PilatesNow's fee on every booking is charged to the Studio, never to you.
  • Prices for deal listings are dynamic and may change or become unavailable at any time before you complete a booking. The price you are charged is the price displayed and confirmed at the moment your booking is completed.

7. Cancellation and Refund Policy

  • Cancelling a booking. You may cancel a booking from your account more than 24 hours before the class starts for a full refund. If you cancel within 24 hours of the class, you will receive a 50% refund and the Studio keeps the rest, because it was holding your spot. Bookings made within 24 hours of the class start are final and cannot be cancelled or refunded, and failing to attend is not a cancellation. This applies to deal bookings and full-price bookings alike, and you are shown this policy before you complete each booking. Classes booked with a membership or voucher are returned to it if you cancel more than 24 hours before the class, and are used if you cancel later.
  • Class packs. A class pack gives you a set number of classes at one studio, to use before the expiry date shown when you buy it. Pack purchases are final and unused credits are not refunded or extended once the pack expires. If you cancel a class more than 24 hours before it starts, or the studio cancels it, the credit goes back to your pack (if the pack has not expired). Intro offers are for first-time clients of that studio only.
  • Waitlists. If a class is full you can join its waitlist. We email you when a spot opens, but spots are first come, first served: joining the waitlist does not reserve or guarantee a spot.
  • If a Studio cancels a class you've booked, you will be refunded in full to your original payment method automatically, or, if you booked with a membership or Flight voucher, the class will be returned to it. Refunds typically appear within 5–10 business days, depending on your bank.
  • If you are denied entry to a class you booked in good faith due to a scheduling error, PilatesNow will provide a refund or rebooking assistance at its discretion.

8. Assumption of Risk

Participation in fitness classes carries inherent physical risk, including risk of injury. By booking a class through the Service, you acknowledge and voluntarily assume all risks associated with physical exercise and class participation at the Studio, and agree that neither PilatesNow nor the Studio is liable for injuries except to the extent caused by gross negligence or willful misconduct where such liability cannot be lawfully waived.

9. User Conduct

You agree not to: misuse the Service, interfere with its operation, scrape, harvest, or extract data from the Service using automated means without our prior written consent, attempt to book a spot without intent to attend, harass Studios or other users, or use the Service for any unlawful purpose. We reserve the right to suspend or terminate your account at any time, for any reason or no reason, with or without notice — not limited to violations of these Terms.

10. Intellectual Property

All content on the Service — branding, design, software — is owned by PilatesNow or its licensors. Studios retain ownership of their own names, logos, photos, and class descriptions, and grant PilatesNow a license to display them on the Service.

11. Third-Party Studio Websites and Non-Endorsement

The Service may link to Studios' own websites or booking systems. PilatesNow does not endorse and is not responsible for the content, accuracy, privacy practices, or availability of any third-party website. Visiting a linked third-party site is at your own risk and subject to that site's own terms.

12. Disclaimers

The Service is provided "as is." PilatesNow does not guarantee the accuracy of Studio-provided information (schedules, pricing, class descriptions) and is not responsible for a Studio's failure to honor a booking, subject to Section 7.

13. Limitation of Liability

To the maximum extent permitted by law, PilatesNow's total liability for any claim arising from your use of the Service is limited to the amount you paid PilatesNow in the twelve months preceding the claim. PilatesNow is not liable for indirect, incidental, or consequential damages.

14. Indemnification

You agree to indemnify and hold PilatesNow harmless from claims arising from your violation of these Terms or your misuse of the Service.

15. Electronic Signature and Communications

By clicking "I agree," creating an account, or otherwise using the Service, you consent to conduct business electronically. Your electronic acceptance of these Terms, or any other agreement presented through the Service, has the same legal effect as a physical signature.

16. Dispute Resolution, Arbitration, and Governing Law

Before filing any claim against PilatesNow, you agree to first contact us at support@pilatesnowapp.com and attempt to resolve the dispute informally for at least 30 days.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

17. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Assignment

PilatesNow may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a sale, merger, or transfer of the business. You may not assign your rights or obligations under these Terms without our prior written consent.

19. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
